Abstract

Delegated legislation has become an indispensable component of modern governance, enabling the executive to formulate detailed rules, regulations, notifications, and by-laws within the framework established by the legislature. The increasing complexity of administrative functions, rapid technological advancements, and the expanding role of the welfare state have made it impracticable for legislatures to enact exhaustive statutory provisions for every aspect of governance. Consequently, the delegation of legislative powers has emerged as a practical necessity for ensuring administrative efficiency, flexibility, and timely implementation of public policies. However, the exercise of delegated legislative authority raises significant constitutional and democratic concerns relating to the separation of powers, legislative supremacy, accountability, transparency, and protection of fundamental rights.

This paper critically examines the constitutional foundation, scope, and limitations of delegated legislation in India, with particular emphasis on the doctrine of excessive delegation, judicial control, and mechanisms of administrative accountability. It analyses the constitutional framework governing delegated legislation, relevant statutory provisions, and the evolving jurisprudence developed by the Supreme Court of India through landmark decisions. The study further evaluates legislative and judicial safeguards designed to prevent arbitrary exercise of delegated powers while ensuring effective governance. A comparative analysis with the legal frameworks of the United Kingdom and the United States highlights international approaches to delegated legislation and offers valuable insights for strengthening India's regulatory system.

Adopting a doctrinal and analytical research methodology, the study relies on constitutional provisions, statutes, judicial precedents, parliamentary committee reports, and scholarly literature to evaluate the effectiveness of existing control mechanisms. The paper argues that while delegated legislation is constitutionally permissible and administratively indispensable, its legitimacy depends upon clearly defined legislative policies, adequate parliamentary oversight, effective judicial review, procedural transparency, and institutional accountability. It concludes by recommending legal and administrative reforms to reinforce constitutional governance, enhance democratic accountability, and maintain an appropriate balance between administrative efficiency and the rule of law in India's evolving regulatory landscape.
