Abstract

The concept of legal rights has undergone a profound transformation from its philosophical origins in natural law to its contemporary recognition as a cornerstone of constitutional governance and international human rights law. Initially grounded in the belief that rights are inherent, universal, and derived from nature or human reason, the understanding of rights has evolved through the contributions of various schools of jurisprudence, including legal positivism, historical, sociological, and realist theories. In the modern era, legal rights have expanded beyond civil and political liberties to encompass economic, social, cultural, environmental, digital, and collective rights, reflecting the changing needs of democratic societies and the emergence of global constitutionalism.

This research critically examines the evolution of legal rights in contemporary jurisprudence by analysing the transition from natural rights to modern human rights and constitutional protections. The study explores the theoretical foundations of legal rights, the contributions of leading jurists, and the influence of constitutional principles in safeguarding individual dignity, equality, liberty, and justice. It further evaluates the role of international human rights instruments, constitutional courts, and judicial activism in broadening the scope of legal rights, particularly in the Indian constitutional framework. Landmark judicial decisions of the Supreme Court of India are examined to demonstrate how constitutional interpretation has transformed fundamental rights into dynamic instruments for the protection of human dignity and social justice.

Adopting a doctrinal and comparative research methodology, the paper analyses constitutional provisions, international conventions, judicial precedents, and scholarly literature to assess the evolving nature of legal rights. A comparative study of India, the United Kingdom, the United States, and selected international human rights regimes highlights diverse constitutional approaches to rights protection. The study concludes that contemporary jurisprudence has shifted from a narrow conception of legal rights towards a broader, rights-based constitutional order founded upon the principles of human dignity, rule of law, democratic governance, and social justice. It argues that the future development of legal rights must respond to emerging challenges posed by globalization, technological innovation, artificial intelligence, environmental degradation, and digital governance while preserving constitutional values and universal human rights.
